  1. Hisense x Clover – “Win With Hisense & Clover” Promotion

    Terms and Conditions

    1. PROMOTION OVERVIEW

    1. This promotional competition (“the Promotion”) is run by Hisense South Africa (Pty) Ltd (“Hisense”) and Clover S.A. (Pty) Ltd (“Clover”), together with their authorised agent/s and/or representative/s (“the Promoters/we/us/our”).
    2. Subject to the specific timeframes set out in clause 3.2 which are applicable to the “Clover Buy & Win”, the Promotion will run from 00h01 on 12 November 2025 to 23:59 on 31 March 2026 (“Promotion Period”) at selected franchise stores as set out herein. No entries received after the end of the Promotion Period, or outside of the specific timeframes set out in clause 3.2 in relation to the “Clover Buy & Win”, will be considered.
    3. The Promotion shall consist of 2 parts as set out more fully below, namely, “Clover Buy & Win” and “Hisense Buy & Win”.
    4. Each person entering the Promotion (“participants/entrants/you/your”) and/or accepting any prize in terms of the Promotion, agrees and accepts that the Promotion rules as set out in these terms and conditions (“Rules”) are binding on him or her and agrees to comply with the Rules.

    1. The Promotion shall only be held, and therefore, prizes shall only be available to be won at designated participating Wholesaler store where promotional point-of-sale material is visibly displayed (“participating store/s”). Accordingly, not all franchise stores shall be participating in the Promotion.

    3. CLOVER BUY & WIN

    1. How to Enter
        1. If an entrant purchases at least 1 Participating Clover Product (as listed in clause 7 below) from a participating wholesale store, he/she shall be entitled to enter a draw to win a Hisense Prize (as defined below).
        1. In order to enter the Clover Buy & Win  giveaway, you must:
      1. purchase at least 1 Participating Clover Product at a participating wholesale store;

      1. Provide your full details: Name, Surname, Email Address, Cell Phone Number.
      2. Upload your proof of purchase.
        1. There is no restriction on the number of times you may enter during the Promotion Period, subject to clause 3.2 below, provided that each new entry complies with the requirements of these Rules. Therefore, each valid till slip counts as one entry, and multiple entries are allowed with separate purchases and till slips.
        1. Each entrant shall only be eligible to win one Hisense Prize.
        1. You acknowledge that any personal information submitted by you for purposes of the Promotion (including but not limited to your name and contact details) shall be collected, used, stored and processed by the Promoters for purposes of the draw (including but not limited to viewing the entries, selecting and announcing the winners (publicly or otherwise), verifying compliance with these Rules, and contacting winners). You hereby consent to such collection, use, storage and processing of your personal information by the Promoters.
        1. Your entry will be withdrawn should it not comply with these Rules.
    2. Prize Breakdown

    The following Hisense Prize will be available to be won as part of the Clover Buy & Win at the relevant participating stores (“Hisense Prizes”):

    1. Selection of Winners
        1. After the expiry of the Promotion Period, until 31 March 2026 (“Clover Draw Period”), the Promoters or an independent third party shall randomly select 50 different entrants (who have complied with these Rules and whose entries comply with these Rules) who will each win a Hisense Prize (“Hisense Prize Winner/s”). The Hisense Prizes will be allocated by the Promoters to the Hisense Prize Winners at random.
        1. Clover will notify the Hisense Prize Winners by contacting them using the contact details submitted as part of their entries.
        1. If an entrant has not been notified that they are a Hisense Prize Winner before the expiry of the Clover Draw Period, this means that they have not been selected as a Hisense Prize Winner. Entrants who are not selected as Hisense Prize Winners will not be notified to the effect that they have not been so selected.
        1. If Clover is unable to get hold of a Hisense Prize Winner by phone after making 3 attempts at contacting them within a period of 3 business days after the Hisense Prize Winner has been selected, such Hisense Prize Winner will forfeit their Hisense Prize and will have no claim against the Promoters. In the event of a forfeiture as contemplated herein, the Promoters shall have the right, but shall not be obliged, to select a different entrant as a Hisense Prize Winner on the same conditions.
        1. A Clover representative shall hand over the Hisense Prizes to the Hisense Prize Winners at the participating store/s at which the relevant Hisense Prize Winners submitted their entries, and on such dates and at such times as determined by Clover. No other arrangement for the handover of the Hisense Prizes will be made.
        1. Each Hisense Prize Winner shall be required to sign a confirmation of receipt of their Hisense Prize.
        1. The results of the Clover Buy & Win, including but not limited to the Hisense Prize Winners’ names and photos taken at the handover, may be published on the websites of the Promoters or in other media. By entering the Promotion, you expressly consent to photos being taken of you at the handover and to the publication thereof.
        1. Each Hisense Prize Winner shall be obliged to provide Clover with the following for audit and verification purposes on handover:
      1. their valid South African identity document / passport / driver’s licence;
      1. their full name and surname; and
      1. their contact number.

    6. GENERAL TERMS AND CONDITIONS

    1. Eligibility: Open to South African citizens and permanent residents who are natural persons with a valid ID, aged 18+.
    2. Exclusions: Employees, directors, members, agents or consultants of the Promoters, or any other persons who directly or indirectly control or are controlled by the Promoters, participating stores, retailers, agencies, and their immediate families may not enter.
    3. Prize Validity: Prizes are non-transferable, non-refundable, and not redeemable for cash. Winners will not be entitled to choose their prize. The prizes may differ from images or items used in marketing material for the Promotion. Any taxes and/or costs associated with the receipt of any prize shall be for the account of the winner thereof. if the selected prize is unavailable, Hisense reserves the right to substitute it with an alternative of equal value.
    4. Verification: Promoters may request supporting documents to confirm the entrant’s identity and purchase.
    5. Audit Rights: Promoters reserve the right to audit entries and disqualify those suspected of fraud or manipulation.
    6. One-Win Rule: Participants may win only once per entry mechanic unless otherwise specified.
    7. Retailer Disclaimer: Participating stores are not responsible for prize fulfilment or winner contact.
    8. Technical Liability: Promoters are not liable for technical issues, lost entries, or platform or internet outages.
    9. Data Privacy: By entering, participants consent to data usage for prize contact and marketing per POPIA. The Promoters may collect, store and use any personal information of entrants for communication, marketing or statistical purposes. By entering the Promotion, you expressly consent to the aforesaid use.
    1. Content Use: By submitting content (photos/stories), entrants grant the Promoters full promotional rights. By posting any content, images, or comments on the Promoters’ public and/or social media platforms or by sending any such content to the Promoters, an entrant consents to and gives the Promoters a world-wide royalty free licence to reproduce, modify, adapt and publish such content, images or comments for the purposes of promoting the Promoters’ products and/or services.
    2. Platform Independence: This Promotion is not affiliated with WhatsApp, Facebook, Telkom, MTN, Vodacom, or Cell C.
    3. Promotion Changes: Promoters may change or cancel the Promotion due to unforeseen circumstances, in their sole discretion.
    4. Amendment of Rules: The Promoters may in their sole discretion amend these Rules at any time, without notice.
    5. Dispute Resolution: Promoters’ decisions are final and binding. No correspondence will be entered into. The Promoters will interpret these Rules in their sole discretion.
    6. Legal Jurisdiction: This promotion is governed by South African law.
    7. If you are not eligible to enter the Promotion in terms of these Rules, you will forfeit any prize that may be allocated to you in terms of this Promotion. The Promoters reserve the right to request you to provide necessary proof that you have met the eligibility requirements. Should you fail to provide such proof within a reasonable time, you will be disqualified and any prizes will be forfeited and returned if applicable.
    8. By entering the Promotion and/or accepting any prize, the entrants, users and/or winners hereby indemnify, release and hold harmless the Promoters (including their subsidiaries, holding companies and affiliates), their directors, employees, agents, suppliers and contractors (“Promoter Parties”) from and against any actions, claims and/or liability for injury, loss, damage, expense, claim and/or amount of any kind resulting in whole or in part, directly or indirectly, from participation in the Promotion, and/or the use, acceptance or possession of a prize, and/or participation (or non-participation) in a prize-related activity.
    9. Any prize is accepted by a winner at his/her own risk and the Promoters are not liable, at any time, for any defect in the prize.
    10. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrants or the Promoters in terms of the Consumer Protection Act, 68 of 2008.
